By accessing or using CardTracker.au ("the Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site. How we handle your personal information is described separately in our Privacy Policy.

What We Are

CardTracker.au provides market data, price tracking, and deal-discovery tools for the Australian Trading Card Game (TCG) community. We are an affiliate publisher: we do not manufacture, sell, hold inventory of, or ship any physical products ourselves. All purchases you make after clicking a link from our Site are completed directly with the third-party retailer or marketplace seller.

No Warranty on Pricing or Availability

Prices, stock levels, and market valuations displayed on the Site are sourced from third-party retailers and marketplaces and can change or be withdrawn at any time without notice. We make reasonable efforts to keep this data accurate and current, but we do not guarantee its accuracy, and you should always verify price and availability on the retailer's own site before purchasing.

Affiliate Relationships

We participate in affiliate programs, including the eBay Partner Network. This means we may earn a commission on qualifying purchases made through links on the Site, at no extra cost to you. See our Return Policy for our full affiliate disclosure.

Trademarks

Pokémon, and other trading card game names, logos, and card imagery referenced on this Site are trademarks of their respective owners. CardTracker.au is an independent, fan-operated resource and is not affiliated with, sponsored by, or endorsed by The Pokémon Company, Nintendo, or any other game publisher.

Community Platforms

Our Discord, WhatsApp, Telegram, and Reddit communities are provided as a convenience for real-time alerts and discussion. Use of those platforms is also subject to their own respective terms of service, and we reserve the right to moderate or restrict access to our communities at our discretion.

CardTracker Marketplace

The CardTracker Marketplace lets members list cards for sale or trade and contact each other about them. It is currently offered as a private beta, which means features may change, and listings or other data may be reset while we develop it.

We are a venue, not a party to your transaction. We do not hold, inspect, authenticate, grade, store, or ship any card listed by a member. We do not process payments, we do not hold funds, we provide no escrow, and we cannot reverse, refund, or recover a payment. Every payment and postage arrangement is made directly between members, off the Site, at their own risk. Our role ends at introducing a buyer to a seller.

You must have a CardTracker account to list a card, to message another member, or to report a listing. You are responsible for activity under your account. During the beta there is a limit on how many active listings each member may have.

Seller and Buyer Responsibilities

If you list a card, you confirm that:

• you own it and have the legal right to sell or trade it;
• it is genuine, and not counterfeit, proxy, altered, or reproduction;
• your description and condition grading are accurate and not misleading;
• the photographs are your own photographs of the actual card, not images taken from another listing, a search engine, or another seller; and
• you will honour an agreed deal, or tell the other member promptly if you cannot.

If you buy or trade, you are responsible for satisfying yourself as to the card and the other member before you send money, and for choosing a payment method appropriate to the risk. Please read our payment and trading safety guide first.

Prohibited Conduct

You must not:

• list counterfeit, stolen, or illegally obtained items;
• misrepresent a card's condition, authenticity, or identity;
• use photographs you did not take, or photographs of a different card;
• take payment without delivering, or otherwise defraud another member;
• harass, abuse, threaten, or discriminate against another member, including in private messages;
• pressure another member towards a payment method in order to evade buyer protection;
• submit false or retaliatory reports or reviews, or review a dealing that did not take place;
• evade a block, a listing removal, or an account suspension, including by creating another account; or
• collect or publish another member's personal information.

Moderation and Enforcement

Members can report a listing or a member. Where a listing is reported by enough separate members it is hidden automatically pending review. We may, at our discretion and without prior notice, hide or remove any listing, restrict access to the Marketplace, or suspend or ban an account that we reasonably believe breaches these Terms. Where an account is banned, its active listings are removed.

Moderation is best-effort and is not a guarantee about any member, listing, or card. The absence of a moderation action does not mean a listing or member has been verified or approved by us.

Reviews

After a dealing is marked completed, both members may leave one review of each other. Reviews must be honest and based on an actual dealing. We may remove reviews that are abusive, contain personal information, are plainly retaliatory, or relate to a dealing that did not occur. Reviews reflect the views of individual members, not of CardTracker.au.

Member Content

You keep ownership of the listing text and photographs you upload. By uploading them, you grant us a non-exclusive, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating and promoting the Marketplace. You are responsible for ensuring you have the rights to anything you upload.

Market Prices Are Estimates

Market figures shown against a listing are estimates derived from observed sales data and are provided for general information only. They are not a valuation, an appraisal, an authentication, or financial advice, and must not be relied on as the basis of a transaction.

Acceptable Use

You agree not to misuse the Site, including by scraping it at disruptive volume, attempting to circumvent our security measures or rate limits, interfering with other members' use of the Site, or using it for any unlawful purpose.

Limitation of Liability

The Site is provided "as is" without warranties of any kind. To the maximum extent permitted by law, CardTracker.au is not liable for any indirect, incidental, or consequential loss arising from your use of the Site or any transaction completed with a third-party retailer.

In particular, and to the maximum extent permitted by law, we are not liable for any loss or damage arising out of a dealing between members, including non-delivery, non-payment, a counterfeit or misdescribed card, a payment sent to the wrong person, a scam, or any dispute between members. You deal with other members at your own risk.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
